Our food laws are not made by our Parliament but are developed, implemented and enforced by a strong cooperative joint system. The Food Standards Australia New Zealand Act 1991 sets out the process for developing and amending joint food standards for Australia and New Zealand. The steps undertaken include a risk analysis by Food Standards Australia New Zealand (FSANZ), stakeholder consultation, and oversight by the Australia and New Zealand Ministerial Forum on Food Regulation (The Forum).
After FSANZ notifies the Forum of a draft standard or draft variation to the Australia and New Zealand Food Standards Code (the Code), the Forum has the capacity to request that the standard be reviewed. A review may be requested if the majority of jurisdictions consider that one or more of the following criteria applies to the standard:
- It is not consistent with existing policy guidelines set by the Forum;
- It is not consistent with the objectives of the legislation which establishes FSANZ;
- It does not protect public health and safety;
- It does not promote consistency between domestic and international food standards where these are at variance;
- It does not provide adequate information to enable informed choice;
- It is difficult to enforce or comply with in both practical or resource terms;
- It places an unreasonable cost burden on industry or consumers.
